These General Terms and Conditions regulate the purchase of products offered on the website www.ikohs.com, owned by WOODS & GO DESIGN, S.L. (CREATE).
The purchase of any of the products entails the full and unreserved acceptance of each and every one of the General Terms and Conditions indicated, without prejudice to the acceptance of the Special Terms and Conditions that may be applicable when purchasing certain products.
These General Terms and Conditions may be modified without prior notice. Therefore, it is advisable to read them carefully before proceeding with the purchase of any of the products offered.

All notifications and communications between users and CREATE will be considered effective, for all purposes, when they are made through the aforementioned means.
The products offered, together with their main characteristics and price, appear in the details of the product files.
CREATE reserves the right to decide the products and/or services offered to Customers. CREATE may thus, at any time, add new products and/or services to the ones currently offered. Likewise, CREATE reserves the right to withdraw or stop offering, at any time and without prior notice, any of the products offered.
All of the above without prejudice to the fact that products may only be purchased by user subscription or registration, with CREATE providing the interested party with a username and password, which will personally identify and enable them to access the products.
Once logged into www.ikohs.com, and to purchase the various products, the user must follow all the instructions indicated in the purchase process, which will mean reading and accepting all the general and specific terms and conditions set out on www.ikohs.com.
Offers made by CREATE are valid depending on the limitations of available stock. CREATE reserves the right to modify the range of its products according to the constraints imposed by its suppliers.
Depending on the availability of the manufacturer, purchased products may be subject to non-substantial modifications with regard the components, characteristics or performance of the batch to which they belong, as long as this does not detract from the qualities and features advertised. Likewise, this information may contain inaccuracies or typographical errors, which may be changed, corrected or deleted at any time. CREATE may make changes or modifications to the products at any time. Images published are merely illustrative.
5. Availability and substitutions
The availability of our products is always indicated in their corresponding product file. You can find more information on how to identify the availability of our products via this link.
CREATE intends to guarantee the availability of all products that are advertised through www.ikohs.com. However, in the event that any product ordered is not available or if the product is out of stock, the customer will be informed.
If the product is not available, and the consumer has been informed, CREATE may supply a product of similar characteristics without an increase in price, in which case the consumer may accept or reject it by exercising their right of withdrawal and termination of the contract.
In case of unavailability of all or part of the order, and rejection of replacement products by the customer, the amount previously paid will be refunded within 15 calendar days.
6. Purchase and/or contracting process
The customer should also print and/or keep a copy of the purchase terms and conditions on a durable medium when placing the order, as well as the receipt sent by CREATE via e-mail.
The invoice will be sent to the customer in electronic format. The customer will receive it in the section “My orders”, which they will find in the customer area.
The order will be delivered to the address indicated by the customer at the time of contracting according to the chosen method and product availability.
Delivery is available to: United Kingdom, except the Isle of Man.
Orders will be delivered to the person and address indicated in the order.
Orders will be delivered to the customer through courier or parcel companies. The order will be considered delivered when the carrier has delivered the package to the customer. It is the customer’s responsibility to check the condition of the goods at the time of receipt and to indicate any anomalies on the delivery note.
In case of anomalies in the order at the time of delivery, you have 48 hours from receipt to notify this. You will find more information here.
The maximum delivery time depends on product availability and the country of delivery. More information on this can be found here. No shipments or deliveries will be made on weekends and public holidays.
8. Prices, costs and taxes
Product prices on www.ikohs.com will be expressed in euros unless otherwise stated and will be guaranteed during the time of validity and regardless of the destination of the order.
The final prices of all products, (and where appropriate, the final prices per unit of measurement, where required) along with their characteristics, offers, discounts, etc., are reflected in each of the items in the catalogue on www.ikohs.com.
• Product prices include VAT.
• The VAT rate is 21%, except for those companies that are registered in the Intra-EU Transactions Registry.
• Shipping costs: Shipping costs, if any, shall be borne by the end customer.
• Return costs: depending on the type of return, shipping or collection costs will be borne by the customer. Please check the return terms and conditions here.
Product prices are subject to change at any time. In this case, the price to be applied will be the price in force on the date the order was placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before they formalise their acceptance.
9. Payment methods
We offer several payment methods:
a. By credit or debit card.
You can pay immediately through the secure payment gateway, Stripe. If the order must be refunded or cancelled, the amount will be refunded on the same payment card. Both personal and banking data will be protected with all the security measures established by the Organic Law of Data Protection 15/1999 and its Development Regulation with total confidentiality.
CREATE accepts VISA, Verified by VISA, MasterCard and MasterCard SecureCode and AMEX payments. The card issuing bank must be located in Spain.
When placing the order, the customer will provide their card details, which will be stored directly on the Stripe gateway during the purchase process. CREATE does not store credit card information. For reasons inherent to the Organisation, collection management is carried out through Banco Santander; this has no impact on the customer.
b. By bank transfer.
Payment can be made by bank transfer or cash deposit to WOODS & GO DESIGN, S.L. to the account number indicated in the order confirmation e-mail. The name of the customer and the order reference must be indicated in the transfer or deposit reference.
Orders that are not paid within 7 days of order confirmation will be automatically cancelled.
PayPal will authorise the payment of the order, but no money will be withdrawn until PayPal verifies that it is correct. This requires having a PayPal account.
10. Return and withdrawal policy
According to regulations, the consumer and user will have the right to withdraw from the contract for a maximum period of 15 calendar days without stating the reason and without incurring any cost, except those provided for in Art. 107.2 and 108 of RD1/2007, of 16 November, which approves the text referred to in the General Law for the Defence of Consumers and Users.

You can cancel an order as long as it is not being prepared. To do so, you must access "My Orders" in your customer area. Once there, select the order you want to cancel and choose the option "Request to cancel the order".
If your order has already been prepared, it is not possible to cancel it. Once you have received the package, you can return one or more of the products.
All our products come with a two-year guarantee, during which time we cover any manufacturing fault. Please note that batteries are considered as “perishable goods”, meaning that they cannot be used appropriately without them being consumed due to their inherent nature. We therefore inform you that the batteries in our products have a shelf life of one year, based on the wear and tear caused by normal use of these components.
CREATE accepts no liability for damage caused by non-professional installation; products modified or manipulated by the customer or any other person not authorised by the manufacturer; inappropriate use, handling and/or short circuits, obvious signs of incorrect use.
The product to be repaired or replaced must always be the same as that delivered by CREATE, attaching the delivery note and/or invoice. Please consult the following information to make use of the right of guarantee.
It is important that the product being sent for repair/replacement is perfectly packaged and protected. If the product arrives at CREATE premises with damage attributable to faulty packaging or protection, the repair may not be covered by the guarantee.
Guarantees do not cover consumables, faults caused by incorrect use or handling, connection to an electricity network not as specified, incorrect installation, or flaws due to any external cause.
For durable products, the consumer will have the right to a suitable technical service and the existence of spare parts for a minimum of 5 years from the date when the product is no longer manufactured, without this increasing the price of the parts when used in repairs.
To avoid problems with the installation or operation of the purchased product, be sure to follow the installation and operating instructions contained in the user manuals.
The warranty does not cover damage caused by external factors such as power surges or drops, atmospheric phenomena, fire, water, abnormal use of the product, accidental drops or incorrect use by private individuals or companies not authorised by CREATE. Likewise, it does not cover wear and tear due to hours, or hours of misuse or negligence before or during use, as well as faults caused by incorrect installation or incorrect handling and storage. Claims for natural loss of brightness or degradation of brightness are exempt from warranty coverage.
CREATE reserves the right to examine each returned product by independent specialists. The warranty is exempted if it is proven by the competent authorities that the breakage was caused by misuse by the customer. In these cases, the costs of the expert assessment shall be borne by the customer.
CREATE is not obliged to compensate the Customer or third parties for the consequences of improper use of the product, be it direct or indirect damage, accidents suffered by persons, damage to property other than the product, loss of profit or loss of earnings.
12. Liability and disclaimer of liability
The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract terminated, in accordance with the provisions of the General Law for the Defence of Consumers and Users.
If the product is not in conformity with the contract, the consumer may choose between repair or replacement of the product, both free of charge for the consumer, which will be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.
If, once the repair has been completed and the product has been delivered, it is still not in conformity with the contract, the consumer may demand a replacement, a price reduction or termination of the contract.
CREATE may suspend, withdraw or cancel all or part of the products not subject to contract at any time and without prior notice. The above provision shall not affect products are reserved for registered users or subject to prior contracting and which shall be governed by their specific terms and conditions.

14. Applicable legislation
The parties submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts of the user’s address. The language used will be English.
